1. Acceptance of Terms

By accessing or using FlowDrafts ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Data Processing Agreement (DPA). If you disagree with any part of the terms, you may not access the Service.

The Service is intended for use by businesses and professionals. By using the Service, you represent and warrant that you are using the Service for business or professional purposes and not as a consumer.

2. Description of Service

FlowDrafts is a Microsoft Outlook add-in that enables users to create and send personalized email campaigns. The Service includes features for contact management, email template creation, and campaign analytics.

3. User Accounts

3.1 Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

4.1 Pricing

Fees for the Service are as set forth on our pricing page or at the point of purchase. Prices are subject to change with 30 days' notice.

4.2 Billing

Subscriptions are billed monthly or annually in advance. Payment is processed through Stripe. You authorize us to charge your payment method on a recurring basis.

4.3 Refunds

We may offer a free trial period. The duration and terms of any such trial will be specified at the point of registration. After any applicable trial, payments are non-refundable except as required by law or at our sole discretion.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Access continues until the end of your current billing period.

5. Acceptable Use

You agree not to use FlowDrafts to:

• Send unsolicited bulk email (spam)
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit malware, viruses, or harmful code
• Harass, abuse, or harm others
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Collect user data without consent

6. Intellectual Property

6.1 Ownership

The Service, including all content, features, and functionality, is owned by FlowDrafts and is protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service for its intended purpose.

6.2 Reselling and Redistribution

Reselling, sublicensing, or otherwise redistributing the Service or any part thereof is permitted only to authorized partners or under a separate written agreement with FlowDrafts. Unauthorized reselling or redistribution is strictly prohibited and will be considered a material breach of these Terms, which may result in immediate account termination and legal action.

7. User Content

You retain ownership of any content you create using the Service (emails, templates, contact lists). You grant us a limited license to process this content as necessary to provide the Service.

8. Third-Party Integrations

FlowDrafts integrates with Microsoft Outlook and may integrate with other third-party services. Your use of these services is subject to their respective terms and policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOWDRAFTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

11. Indemnification

You agree to indemnify and hold harmless FlowDrafts from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

16. Assignment

Your continued use of the Service after any such transfer constitutes your acceptance of the new entity as your service provider.
